Pretrial Diversion Programs for DUI in Tampa Bay

Navigating the legal aftermath of a DUI charge can be challenging, but understanding the available alternatives, like pretrial diversion programs, can make a significant difference in your outcome. In Hillsborough and Pinellas counties, such programs include RIDR (Reducing Impaired Driving Recidivism) and D.R.O.P (Diversionary Rehabilitation Opportunity Program).

By participating in these programs, you might avoid a conviction on your record, receive educational resources, and even alleviate some of the penalties typically associated with DUI charges.

In this article, our defense lawyers will walk you through the specifics of RIDR and D.R.O.P, to help you understand how these alternative paths can facilitate your journey toward rehabilitation.

What Are DUI Pretrial Diversion Programs?

DUI pretrial diversion programs are alternative legal avenues designed to help first-time offenders avoid the harsh consequences of a DUI conviction. These programs offer a chance to rehabilitate instead of facing traditional criminal proceedings.

By participating, you can work towards dismissing your DUI charges upon completing specific requirements, such as attending educational courses, undergoing substance abuse treatment, and performing community service.

Understanding Hillsborough County’s RIDR Program

In March 2018, the State Attorney’s Office introduced a program called Reducing Impaired Driving Recidivism (RIDR).

The state attorney will also suggest a withhold of adjudication as a component of the sentence, which is a significant advantage of this program. The judge will ultimately make the final choice, but if it is approved, most offenders will be able to have their records sealed once their cases are closed.

Eligibility Requirements:

  • Only those with no prior DUI convictions or diversions are considered for the RIDR program. But you must blow under .20 BAC at the time of the traffic stop
  • The offense must not involve an accident causing serious injury or death
  • Participants should have a valid driver’s license at the time of arrest
  • The DUI offense must not involve a minor in the vehicle at the time of arrest
  • Admission into the RIDR program requires approval from the State Attorney’s Office

Exploring Pinellas County’s D.R.O.P Program

Pinellas County offers the Driver’s Rehabilitation of Offenders Program (D.R.O.P) as a pretrial diversion opportunity that is similar to Hillsborough County’s RIDR program.

Eligibility Requirements:

To enter the D.R.O.P. program include performing the following three pre-plea conditions:

  • Complete twenty (20) community service hours
  • Complete DUI school
  • Complete the M.A.D.D. Victim Impact Panel

Also, defendants must meet these requirements:

  • No prior DUI convictions
  • No other significant criminal history
  • Not involved in a motor vehicle accident related to the DUI charge
  • No minor was present in the vehicle at the time of the arrest
  • Breathalyzer reading below 0.20

Once the pre-plea conditions are met and you are accepted into D.R.O.P., the State Attorney’s Office will agree to the following resolution of the criminal case:

  • Reduction of charges to a lesser offense such as Reckless Driving
  • Dismissal of the charge upon successful completion
  • Avoidance of a formal conviction on your record
  • Elimination of mandatory jail time
  • No driver’s license suspension

This resolution highlights the significant benefits for participants, allowing them to put the incident behind them and move forward with their lives without the lasting stigma of a DUI conviction.

Note: Pretrial DUI diversion programs are NOT available for drivers who hold a CDL.
